About these terms
These Terms of Use apply to the James Taylor Electric Violinist website. They explain the basis on which the website and its content are made available.
By using the site you agree to use it lawfully and in accordance with these terms. If you do not agree, please do not use the site.
These terms govern use of the website. A performance booking is governed by the quotation, booking confirmation, invoice, Performance Agreement & Booking Terms and any other terms specifically and mutually agreed for that booking. If there is a conflict, the specifically agreed booking terms take priority for that booking.
Website information
The site provides information about performance services, wedding packages, other events, availability routes, public performances, collaborations, reviews and related work. We aim to keep this information accurate and useful, but content can change and may occasionally contain errors or become out of date.
Unless a price or service detail has been confirmed directly as part of a quotation or booking, website information should be treated as general information rather than a binding offer.
Images, testimonials, past-performance information and examples of previous work illustrate the type of service offered; they do not guarantee that every venue, arrangement, repertoire choice or production setup will be available for every booking.
Bookings, quotations and availability
Submitting an enquiry or booking form does not by itself guarantee availability or create a confirmed performance booking. Availability, price, package details, travel arrangements, timings and practical requirements are subject to confirmation.
A booking becomes binding only in accordance with the confirmation and contract process communicated for that booking. Where a Booking Fee or full payment is required as a condition of confirmation, the date is not treated as confirmed until the stated condition has been met.
Cancellation, rescheduling, performance, payment, force-majeure and other booking-specific provisions are dealt with in the Performance Agreement & Booking Terms and the event-specific booking documents rather than these website Terms of Use.
Consumer rights
Nothing in these Terms of Use is intended to exclude or restrict rights that cannot lawfully be excluded or restricted. If you book as a consumer, any mandatory rights and remedies available under applicable consumer law continue to apply.
Different legal rules can apply to contracts for leisure-related services supplied on a specific date or during a specific period. Any cancellation rights that apply to an actual performance booking will therefore be addressed in the booking process and contract rather than assumed from these website terms.
Intellectual property
Unless stated otherwise, the website design, written content, branding, graphics, photographs, videos, arrangements and other original material are protected by copyright, trade mark or other intellectual-property rights belonging to James Taylor Electric Violinist, Elegance Music, their licensors or the relevant credited owner.
You may view the site and may print or save reasonable extracts for your own personal, non-commercial use. You must not reproduce, republish, sell, scrape, distribute, alter or commercially exploit a substantial part of the site or its content without permission, except where the law allows it.
Nothing on this site grants a licence to use the James Taylor Electric Violinist name, logo or branding in a way that suggests endorsement, partnership or affiliation without permission.
Acceptable use
You must not knowingly misuse the website. In particular, you must not:
- use the site for unlawful, fraudulent or abusive purposes;
- attempt unauthorised access to the site, server, hosting environment or another user's systems;
- introduce malware, malicious scripts or other harmful material;
- interfere with the normal operation, security or availability of the site; or
- use automated extraction, scraping or similar systems in a way that infringes rights or places an unreasonable load on the site.
Linking to this website
You may link to publicly available pages in a way that is fair and lawful and does not damage the reputation of James Taylor Electric Violinist or suggest an association or endorsement that does not exist.
You must not frame the website within another site or present copied content in a way that could mislead users about its source. We may ask for a link to be removed where it is misleading, unlawful or otherwise inappropriate.
External links and third-party services
The site links to, and on some pages uses, third-party services including Google My Maps, Google Fonts, Instagram, Facebook and external venue or business websites. The native Contact and Booking forms are part of this website, although delivery of form messages depends on the website hosting and email infrastructure. Third-party services are operated independently and may have their own terms, privacy notices and availability arrangements.
A link to another site does not mean that we control or endorse everything on that site. We are not responsible for third-party content or for changes made by a third-party service after you leave this website.
Website availability and security
We may update, suspend, withdraw or change parts of the site without notice. We do not guarantee that the site will always be available, uninterrupted, error-free or free from every security risk.
You are responsible for using appropriate security protections on your own device and for deciding whether an external link or download is suitable for you.
Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such liability cannot legally be excluded.
Subject to those protections, the website is provided primarily for general information and enquiry purposes. To the fullest extent permitted by law, we are not responsible for losses caused solely by relying on general website information that has not been confirmed as part of a quotation, booking or direct communication.
We are not responsible for failures caused by a third-party website or service that is outside our reasonable control, although this does not affect any responsibility we may have under an actual booking contract.
Privacy and cookies
Personal information and website storage/access technologies are dealt with in the Privacy Policy and Cookie Policy. You can reopen the site's optional-content preferences from Cookie Settings.
Governing law and jurisdiction
These website Terms of Use are governed by the law of England and Wales, subject to any mandatory rights you have under the law that applies to you as a consumer.
If you are a consumer resident elsewhere in the United Kingdom, nothing in this clause removes any mandatory protection or right to bring proceedings that the law gives you in your part of the UK.
